Terms of service
Last updated: 12 October 2026
These terms cover buying from Spencer's Garage at spencersgarage.com.au. Please read them before you order. You'll be asked to tick a box in your cart to confirm you've read them.
Nothing in these terms takes away your rights under the Australian Consumer Law (the ACL, the national law that protects people who buy goods in Australia). If anything here ever seems to say otherwise, the ACL wins.
1. Who we are
Spencer's Garage is a registered business name of Grohn Associates Pty Ltd, ABN 49 125 863 461. We're an online die-cast store and we post from Queensland. There's no Spencer's Garage shopfront.
Email: spencersgarage@outlook.com.au
Phone: 0432 415 471
Returns: Spencer's Garage, c/- Nick's Aquarium Oceanarium Terrarium, Unit 14/88 Flinders Parade, North Lakes QLD 4509
2. Where our stock comes from
We sell genuine Hot Wheels die-cast cars, Monster Jam die-cast trucks and related collectibles. Our stock comes from a few places, and we think you should know which:
- New stock. Brand new, unopened items.
- Collector stock. Single pieces and whole collections we buy from other collectors. These can be still on the card or loose, new or pre-loved.
- Retail store stock. New items we buy from Australian retail stores, including the big chain stores. Plenty of collectors can't get to a store when new stock lands, or live where certain cars never make it to the shelves. We do the hunting so you don't have to.
Because retail store stock comes off a shop shelf, the card may already show light handling or shelf wear before it reaches us. That's why we grade the card condition on our listings (see section 4).
Our prices are our own. For harder-to-find pieces they can be higher than the recommended retail price (RRP, the price the maker suggests shops charge). The price covers the item and the time it took to find it and get it to you.
We're an independent seller. We are not connected with, sponsored by or endorsed by Mattel (owner of Hot Wheels), Feld Motor Sports (owner of Monster Jam) or Spin Master (maker of Monster Jam toys since 2019; earlier Monster Jam trucks were made by Mattel).
3. Genuine products
We only sell genuine products. If you believe something you bought from us isn't genuine, contact us. If it isn't, we'll refund you in full, including postage both ways.
4. Condition, photos and defects
The words we use:
- Carded means still sealed in its original card and blister (the clear plastic bubble).
- Loose means out of its packaging.
- Pre-loved means it has had a previous owner and may show wear.
Card condition grades:
- Mint: the card and blister look as they left the factory, apart from tiny marks you'd only spot up close.
- Near mint: light wear, such as a soft corner, a small crease or light scuffing.
- Marked: obvious wear, such as creases, bends, a dented or cracked blister, price stickers or sticker residue. The listing says what.
Our grades are our own honest assessment of the packaging. We aren't a professional grading service, and a grade isn't a statement about value.
Defects. We look over every item before we list it, and we put any defect we find on the product page, in the description or the condition line. That includes chips, scratches, missing parts, loose wheels, card damage and anything else you'd want to know.
Photos. Where we have one of an item, the photos show the actual item you'll receive. Where we have more than one, the photos show one of them, and every unit matches the condition grade on the listing. Colours can look slightly different from screen to screen.
Factory variation. Die-cast cars are mass produced. Small variations are normal, such as printed graphics (tampos) sitting slightly off centre, small paint flecks, or wheels and bases that change between production runs. If something looks beyond normal to you, contact us and we'll look at it.
Defects we've told you about. If a listing tells you about a defect before you buy, that defect is part of what you're buying and is reflected in the price. We won't treat it as a fault later. This matches the ACL, which says an item isn't of unacceptable quality because of a defect that was pointed out to you before you bought it.
Anything we didn't tell you about. If an item has a fault we didn't disclose, or doesn't match its photos or description (including its card grade), you're covered. See section 11.
5. Treasure Hunts, chases and value
A Treasure Hunt (TH) and a Super Treasure Hunt (STH) are harder-to-find versions that Mattel mixes in with its standard Hot Wheels range. A chase is a limited version packed in with some premium series.
We check every TH, STH and chase before we list it. If we've labelled something wrongly, you can return it for a full refund, including postage both ways.
We don't promise that any item will hold its value or go up in value. Collector prices rise and fall.
6. Small parts and children
Most of what we sell is aimed at collectors. Die-cast cars and trucks contain small parts and aren't suitable for children under 3. Check the age marking on the packaging and supervise young children. Loose and pre-loved items can have worn or loose parts, so check them before giving them to a child.
7. Ordering
- Prices are in Australian dollars and include GST. Postage is worked out at checkout before you pay.
- We accept your order when we send your order confirmation email.
- Most of our stock is one of a kind. If the last one sells to two people at the same moment, the later order gets a full refund.
- On high-demand releases we may set a limit per customer so more collectors get a go. Any limit will be shown on the listing.
- One discount code per order, unless the code says otherwise.
- If you need to change or cancel an order, email us before it's posted.
When we might cancel an order. We'll only cancel an order for one of these reasons, and we'll refund you in full, including postage:
- the item has sold out or we find it damaged before it's posted, and you don't want a replacement
- the item was listed at a price that's clearly wrong (we'll contact you first and you can choose to pay the correct price or cancel)
- we reasonably suspect fraud or there's a problem with the payment
- we can't deliver to the address given
- an order goes over a per-customer limit shown on the listing (we'll cancel and refund only the extra items).
8. Pre-orders
If we ever take a pre-order, the listing will say so and give an expected arrival time. If the item hasn't arrived by the expected date, you can cancel at any time before we post it and we'll refund you in full.
9. Postage and delivery
- We post with Australia Post to addresses in Australia, New Zealand and the USA.
- We aim to post orders within 2 business days of payment. We'll email you tracking when it's on its way.
- Delivery times are Australia Post's estimates, not promises from us. If your parcel hasn't arrived within a reasonable time, contact us and we'll chase it.
- Please check your address before you pay. If an order goes to a wrong address you entered, we'll help redirect it, but the cost of sending it again is yours.
- If tracking shows your parcel delivered and you can't find it, check with neighbours and your local post office, then contact us. We'll lodge an enquiry with Australia Post for you. If your parcel is lost, or Australia Post can't show it was delivered to your address, we'll send a replacement or refund you, including postage. You choose.
- If a parcel comes back to us unclaimed, we'll refund the item or post it again once you pay the new postage.
Orders outside Australia. Orders to the USA are sent with US import duties paid by us when we post them. For New Zealand, import duties, taxes and customs fees are your responsibility. Customs can hold parcels for longer than normal delivery times. You may also have rights under your own country's consumer laws, and nothing in these terms limits them.
10. Damaged in transit
We pack every order to protect the card as well as the car. Even so, parcels sometimes get knocked about on the way.
If your order arrives damaged:
- If you can, take photos of the outer packaging and the item before you unpack any further.
- Keep all the packaging.
- Email us your order number and the photos as soon as you can.
We'll lodge the claim with Australia Post ourselves, so you don't have to deal with them. If the damage means the item isn't of acceptable quality, or no longer matches its listed condition grade, you can choose a replacement (if we have another one) or a refund, including the postage you paid for that item.
Telling us quickly helps us claim from Australia Post. It doesn't change your rights.
11. Faults, wrong items and items not as described
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
What that means here:
- If you receive the wrong item, or an item that's faulty, damaged, or doesn't match its photos, description or card grade, contact us. For a major problem you choose a replacement or a refund, or you can keep it and we'll pay you for the drop in its value. For a minor problem we'll replace it, or refund you if we can't.
- Send us photos so we can sort it quickly. We may ask for the item back, and if we do, we'll pay reasonable return postage. Returns go to the returns address in section 1.
- You don't need the original packaging or receipt. Your order number or a bank statement is enough.
- There's no strict cut-off, but please tell us as soon as you notice a problem. It's easier to work out what happened when it's fresh.
What isn't a fault:
- a defect we told you about on the listing before you bought (section 4)
- damage caused after delivery by an accident or by using or storing the item in a way it wasn't made for, such as dropping it or leaving it in direct sun
- factory variation that's normal for that release (section 4)
- changing your mind (section 12).
12. Change of mind
We don't give refunds for change of mind, for example if you ordered the wrong car or saw it cheaper somewhere else. If you contact us within 7 days of delivery, we may accept a return for store credit. That's our call, not a right. The item must come back in the same condition it left us, and you pay the return postage.
13. Pre-loved items
Pre-loved items have had a previous owner. They're covered by the ACL like everything else, but what counts as acceptable quality takes their age and condition into account, and so do we. The listing tells you what we know about wear, paint chips, missing parts and packaging condition. Check the photos and condition notes before you buy, and ask us if you'd like more photos.
14. Protector cases
Protector cases reduce the risk of damage to carded items but can't promise a card will never be damaged.
15. Payment
Payments are processed through Shopify's secure checkout. We don't see or store your full card details.
16. Privacy
We only use your details to process and deliver your order, look after you if there's a problem, and send you marketing if you've signed up for it. See our Privacy Policy.
17. Our website and trademarks
The photos and text on our website are ours. Please don't copy them without our permission. Hot Wheels, Monster Jam and the other brand names on our site belong to their owners, and we use them only to describe the genuine products we sell.
18. Reviews
If you leave a review, please keep it honest and about your own experience. We don't change what reviews say and we don't remove reviews just because they're negative.
19. Our responsibility
Nothing in these terms excludes, restricts or changes any right or remedy you have under the ACL or any other law that can't be excluded. Apart from those rights, we're not responsible for loss that wasn't a reasonably foreseeable result of something we did wrong.
20. Changes to these terms
We may update these terms from time to time. The version on our website when you place your order is the one that applies to that order.
21. Law
These terms are governed by the laws of Queensland, Australia.
22. Questions and complaints
Email us at spencersgarage@outlook.com.au with your order number. We'll work with you to sort it out. If we can't agree, you can contact the consumer protection agency in your state or territory. In Queensland that's the Office of Fair Trading.
